Wreck Victims Win Case Against Estate

A Washington County Circuit Court jury has assessed $369,000 in damages against the estate of an elderly woman who caused a traffic accident in Tacoma in 1996.

Witnesses said driver Emma Smith, who was in her late 70s, turned left into the path of another vehicle at the intersection of 12th Blvd. and Main Street. The driver died as a result of the crash, while the driver of the other car, Linda Hart, suffered injuries to her foot, hand and mouth. Her 6-year old daughter, Emily, had both her thighs broken.

The Harts ran up about $60,000 in medical bills after the accident. Linda has had repeated operations on her legs, but doctors say they do not expect her to have permanent impairment.
The jury awarded $257,000 in damages Wednesday to the little girl, who is now age 8; $94,000 to the driver; and $18,000 to her husband, who was not involved in the wreck.

The Harts were represented by Joseph Ford of Frank, Foley & Ford.
